Pledge of Allegiance Now Unconstitutional in School

A federal judge in Sacramento has ruled that it is unconstitutional to say the Pledge of Allegiance in public school due to the words "under God" (h/t HolyCoastMom).
The Pledge of Allegiance was ruled unconstitutional Wednesday by a federal judge who granted legal standing to two families represented by an atheist whose previous attempt to get the pledge out of public schools was rejected by the U.S. Supreme Court.

It looks like a temporary victory at best for the atheists. This issue still hasn't made it to the Supremes. I wonder who will be first to ask Judge Roberts about this? Of course, he won't be able to respond since he'll be in charge of the Supremes when this case comes up there.

UPDATE: This ruling will be pretty limited initially, just applying to selected school districts:
Karlton, ruling in Sacramento, said he would sign a restraining order preventing the recitation of the pledge at the Elk Grove Unified, Rio Linda and Elverta Joint Elementary school districts in Sacramento County, where the plaintiffs' children attend.

The order would not extend beyond those districts unless it is affirmed by a higher court, in which case it would apply to nine western states.
