I'm not watching the California Supreme Court hearing on the merits of Proposition 8 and gay marriage in California, but Flap is and I've been following his Twitter feed. Flap seems to think that the Supremes are leaning heavily in favor of Prop 8 based on their questioning of the anti-Prop 8 plaintiffs. They don't seem to be buying the argument that Prop 8 was an revision of the constitution (not allowed) versus and amendment to the constitution (allowed).
Probably the most hilarious argument made so far is from Attorney General Jerry Brown's lacky who is claiming the people of California have the right to amend the constitution, but only in limited ways (re: only in politically correct ways). The justices appear to be chewing him up and spitting him out.
I wrote previously that I thought Brown was abandoning his oath of office when he decided not to defend the citizens of California in this case which is a requirement of his office.
I hope Flap's right about the court's leaning, but nobody will know until the final decision is rendered sometime in the next 90 days. Flap seems to think it's 5-2 or possibly even 6-1 in favor of Prop 8. And that's before Ken Starr even gets up to defend Prop 8.
