Sometime around 10am PDT the California Supreme Court is due to release their decision in the Proposition 8 gay marriage case. My expectation is that it will be a baby-splitting decision.
Based on the responses of the judges during oral arguments it appears there's a solid majority for upholding Proposition 8 as a valid constitutional amendment, thus keeping gay marriage illegal in California.
However, as a sop to the other side, I fully expect that they'll rule the 18,000 gay marriages that were performed between June 17th and election day in November as valid, thus creating a weird two-tier marriage class system in California. The haves that acted during the brief few months that gay marriage was allowed will be able to keep their licenses, while all the have-nots who missed the opportunity will have to go to Iowa, Vermont, Connecticut, Maine or Massachusetts, though their marriages would not be recognized in California.
Both sides are threatening recall elections against the Supreme Court justices if things don't go their way.
