Echoing comments by President Barack Obama and others in the administration, (ICE Chief John) Morton said that Arizona’s new law targeting illegal immigration is not “good government.” The law makes it a crime to be in the state illegally and requires police to check suspects for immigration paperwork.If a sworn head of a law enforcement agency is unwilling to do his job, he must be removed. He does not get to pick and choose which laws he will enforce, or from which agencies he will or will not accept referrals. If I was Gov. Brewer and heard this I'd have my lawyers all over this guy. And then I'd collect up the next 40 or 50 aliens, put them on a bus, and send them to ICE headquarters in Washington D.C. for an in-person delivery.
Morton said his agency will not necessarily process illegal immigrants referred to them by Arizona officials. The best way to reduce illegal immigration is through a comprehensive federal approach, not a patchwork of state laws, he said.
“I don’t think the Arizona law, or laws like it, are the solution,” Morton said.

It is truly bizarre that the Federal government would choose not to abide by the Federal law that was the basis for the State law that apprehended those in violation of the Federal law. The head of ICE is definitely out of control and should be removed immediately. His successor should be required to support the Arizona law and to process all violators submitted by the state. Perhaps one termination would send the message to ICE, however, if necessary subsequent leaders who disabuse law should also be terminated until one is found who will prosecute and deport illegals detained for any law violation by any agency.
In the 70's, California cops enforced section 241 of the Federal Immigration and Naturalization Code and we used to hold illegal aliens in custody till they were deported because, as non-citizens, they were not entitled to bail. In the early 80's, the California Constitution was changed to apply to "inhabitants" rather than "citizens." We could ... See Moreno longer hold illegals in custody without bail and therefore, were required to release them on their "own recognizance" for misdemeanor crimes. Most didn't show up at trial so the courts issued arrest warrants. I spent many years trying to track down illegal aliens... many had multiple warrants in multiple names. Anyone who says there is no cost to allowing illegal immigrants to stay here should look at the arrest and court records. Our judicial system would be a lot less expensive and swifter if illegals were still being deported like they were 30+ years ago! What would be even better is if they were prevented from coming here in the first place!
