The secretary of state in West Virginia says a special election will not be needed this year to fill the seat vacated with the death of U.S. Senator Robert C. Byrd.Imagine my surprise.
Democratic Secretary of State Natalie Tennant said Monday that based on a review of state law and a 1994 state Supreme Court ruling, Gov. Joe Manchin’s appointee won’t have to face election until November 2012. Tennant’s decision is key for Democrats, who hold a slim majority in the Senate with 36 seats up for election this fall.
Tennant says state law requires appointees to file for the office and then stand for a primary election, and there was not enough time for that this year.
West Virginia’s primary was in May. The next one is in May 2012

WV Secretary of State Decides Robert Byrd Won't Actually Die Until Saturday
The fact that he apparently died at 3am Monday morning doesn't count. The law in West Virginia requires a special election if a Senate seat becomes vacant more than 2 1/2 years before the end of the term. That would have been next Saturday, but in typical Democrat fashion the law is not as important as holding the seat for two more years (h/t Don Surber):

The sad thing is that most Americans will not ever become aware of this because the mainstream news sources are functionally just propaganda distributors for The Left.
