Judge Overturns "Don't Ask, Don't Tell"

I don't even know why we bother to have a congress and elected leaders anymore when a single unelected judge with a lifetime appointment can simply undo with a stroke of a pen anything the elected leadership does.:
A federal judge ordered that the U.S. military stop enforcing the don't ask, don't tell policy on Tuesday.

Judge Virginia Phillips ordered the military "immediately to suspend and discontinue any investigation, or discharge, separation, or other proceeding, that may have been commenced under the "Don't Ask, Don't Tell"."

The judge had previously ruled that the policy regarding gays serving in the military violated service members Fifth Amendment rights but delayed issuing the injunction.
This is probably a big break for Obama. He kept saying he wanted to stop "Don't Ask, Don't Tell" but never did anything about it. Now he can just point to the ruling and doesn't have to actually take a stand.

Isn't it amazing that after 17 years on the books something can suddenly be unconstitutional?
