The Fallacy of "Super-Duper Precedents"

Sen. Dick Durbin kicked things off today in the Alito hearings, and I just heard a small part of his questioning on a radio report. As always, it's all about abortion. Once again a Dem Senator tried to get Alito to state that he would never overturn Roe (and to be fair, Spector more or less did the same thing yesterday). A silly effort at best.

All this talk about "super precedents" or "super-duper-extra-big-humongous precedents" is nonsense, as was pointed out by GOP Senator Sam Brownback, when he brought out the props he used at the Roberts hearing which showed that segregation (Plessy v Ferguson) was a "super-duper precedent" for more than 60 years before being overturned in the Brown v. Board of Education case in 1954. Using Durbin and Spector's logic, separate but equal should still be the law of the land.
