Frivolous Lawsuit of the Day

It really bugs me when I read stuff like this:

NEWPORT BEACH – If you break your neck or even drown while swimming at the beach, who is to blame?

In two recent cases, local families say fault lies with Newport Beach officials, and they've filed legal claims seeking large cash payments as compensation for accidents they believe resulted from city negligence.

One of the claims stems from the March 2008 drowning of Claremont resident Victor Wang, 17, amid rough coastal waters.

"There were no flags posted or visible showing that there was high surf or high wind conditions," says the claim from Wang's family, which requested $20 million.

Does it really require flags to tell that the wind is blowing and the waves are breaking big?

If you're looking for an example of why America needs to switch to a "loser pays" tort system like they have in Britain, here you go. The city will spend big bucks defending this nonsense. In a "loser pays" system the burden would be total on the claimant who would face all of the fees and charges if they lost their case. Lawsuits like this wouldn't even be filed.
